This privacy policy explains how personal information is collected, used and protected when on Tiny Planets (TP) or any of its hosted websites – Tiny Planets Learning, Tiny Planets Fun, Tiny Planets Books, Tiny Planets TV, My Tiny Planets, Tiny Planets Labs and Tiny Planets Blog (collectively “Tiny Planets”). Your child’s online privacy is important and we ask that you read our privacy policy with your child.  We also encourage parents and their children to learn about how they can be safe online by visiting the Federal Trade Commission’s children’s online privacy page that you can access by clicking http://www.onguardonline.gov/topics/kids-privacy.aspx.

This privacy policy does not apply to companies or contractors that TP does not own or control.  But when we use other companies or contractors to provide services required for your use and enjoyment of TP, we require that they protect your or your child’s personal information in a manner that is consistent with this privacy policy.

The term “you” means a child’s parent or legal guardian unless otherwise specified.  The terms “we” or “our” means TP and all of our hosted sites.

What is Tiny Planets?

Tiny Planets is a fun, interactive website where children who are under 14 and their families can learn and play with others. TP and its hosted sites are owned and operated by Pepper’s Ghost Productions, Limited (PGP) and based in the United Kingdom. The details of our privacy policy are explained below but here’s our bottom line:  We take privacy seriously.

  • We only collect minimal personal information and only as necessary to enable participation in the sites’ activities and to make them fun and interesting. When we do collect personal information we use it only for the specific purpose for which it was collected and do not keep the information for any longer than necessary to accomplish that purpose.
  • We tell children not to disclose personal information unless they do so under the supervision of a parent or legal guardian.
  • We take reasonable measures to protect the confidentiality, security and integrity of personal information in our possession.
  • We do not sell a child’s -- or their parent’s or guardian’s -- personal information to anybody.

When we share personal information with third parties it is only so they can perform a specific function required for the operation of the TP website -- and only after they agree not to use that information for any purpose unrelated to the reason we gave it to them in the first place.  

Why Does TP Have a Privacy Policy?

TP has a privacy policy because we want to keep you and your family informed about our information collection practices.  The U.S. Children’s Online Privacy Protection Act Rule also requires that websites like ours give notice to children and their parents about the information we collect and how we use it, and to tell parents how they can give or withhold consent for the collection, storage and use of that information.  More information about the rule is available at the Federal Trade Commission website at: http://www.onguardonline.gov/topics/kids-privacy.aspx

The U.K. and Europe do not have a specific counterpart to the U.S. rule but do have laws that encompass the protection of all online privacy, including children’s information.  

Can a Child Participate in TP’s Activities without Disclosing Personal Information?

Yes.  We have designed TP so a child can enjoy many of TP’s activities for free and without disclosing any personal information.  To play for free on My Tiny Planets, a child is asked to select a gender neutral username from an auto generated list of usernames that he or she can use for playing games on the website. The child is also asked to create a password, and can opt -- but is not required -- to provide an email address to enable password retrieval. 

Unless a child opts to provide his or her e-mail address for password or username reminders,
we do not collect personal information when children enjoy TP’s free activities.

When Does TP Collect Personal Information?

We do collect a limited amount of personal information when:

  • A child wants his or her parent or legal guardian to purchase “Keys” (TP’s virtual currency), premium content, or wants to participate in premium activities or purchase TP products.  In either instance we ask the child’s parent or legal guardian for his or her full name and e-mail address and the child’s screen name so we know who the account is being created for. Your consent to providing this information and to your child’s participation in premium activities or viewing premium content is provided by your completed credit card transaction.
  • A parent or legal guardian creates a parent account solely for player account oversight and management purposes.
  • A child enters a contest that we may offer from time to time on our website.  To participate, a child may be asked to provide his or her first name and to send us an e-mail for entry and prize notification.  We will not use the e-mail address provided by your child for any other purpose.  The name and e-mail address will only be retained until the completion of the contest and will then be immediately deleted from our records. If we must contact the child more than once in connection with the contest, we will ask for a parent or guardian's e-mail address so we can seek consent from the child's parent or legal guardian before we contact the child again in relation to the contest.  We will give you the option of asking us to delete the child's entry in the contest.  If we do not obtain consent after a reasonable period, we will not contact the child again.  A child is not prohibited from participating in a contest if they refuse or are unable to provide the personal information.  TP will provide an alternate means of entry that will be posted on the website.
  • A child would like to send a pre-scripted “e-card” to a friend.  We will only collect the friend’s e-mail address.  We will not ask for, and the sender will not be able to disclose, any personal information in the e-card, including the sender’s e-mail address.  The e-card is generated from a TP e-mail address for transmission purposes. We will send the card immediately and immediately delete the friend’s email address.
  • A child opts to provide his or her e-mail address when creating a free account for the purpose of password or username retrieval.
  • A child contacts us online via his or her or e-mail address more than once with a specific request, for example for username or password reminders. After we respond the first time we will contact the child’s parent or legal guardian to obtain consent to send future password reminders if asked by the child.


Will TP Contact a Parent or Legal Guardian at the Payment or Premium Service E-mail Address?

  • In most cases we will only contact a parent or legal guardian at the payment or premium service e-mail address to send a confirmation notice explaining the premium services purchased by the parent or legal guardian.
  • We may use a parent or legal guardian’s e-mail address to respond to a customer service message acknowledging receipt of an inquiry. In most cases we will   post a response on our customer service blog. In this instance the parent or legal guardian will not be identified.
  • We may use that email to confirm creation of the parent account, or to provide the parent or legal guardian with a means to for password retrieval.
  • We may also contact a parent or legal guardian to enforce Terms and Conditions or send notice of a material change to our privacy policy.

What Will TP use Personal Information for?

  • To send a notice and registration confirmation message to a parent or legal guardian.
  • For username or password reminders.
  • To enable participation in premium activities or contests.
  • To support or improve the operations of the website.
  • To enforce the Terms and Conditions.
  • To defend the integrity of the website.
  • To respond to law enforcement or judicial process.
  • To obtain verifiable parental consent when a child wants to engage in certain premium activities, or, to respond to a specific request from child more than one time.

How Does TP Verify Parental Consent for an Activity?

Once a parent has created a parent account we verify parental consent through the completion of a credit card transaction conducted through the parent account and associated with the purchase of premium activities, content or products.

In the case of multiple password reminder requests, we will seek consent via e-mail requiring that you reply via e-mail and provide an assigned consent and verification code.

Does TP Use Cookies?

TP places a cookie, including a “Flash” cookie, on a user’s computer so we can make the site as fun and interesting as possible.  The cookie may identify a customer’s computer but does not identify an individual user.  The cookie helps us monitor how TP’s website is being used by recording preferences, including how long users spend on the site, which pages are visited most often, which activities are being played the most, and which pages are visited least often.  The cookie may also be used to improve the user experience by directing users to pages and activities they might find of interest. The cookie collects data in the aggregate to give TP general information about how the website is used but does not identify specific individuals, either independently or in combination with other information disclosed by a child.  The cookie cannot automatically perform such individualized functions as remembering a password or username for automatic sign-in purposes. However, the cookie can remember a user’s auto-generated username and the user’s password only if a user selects “remember me”, which a user might do to avoid starting an activity all over again.

You may refuse to accept cookies by setting your computer’s browser preferences to reject or delete cookies, including TP’s, however, by doing so your child may not be able to fully enjoy the website.  Unless you have adjusted your browser setting to reject cookies TP will deposit cookies on your computer when you log on to our site.  In order to delete Flash cookies from your browser you must follow these steps: http://macromedia.com/support/documentation/en/flashplayer/help/settings_manager07.html.

Does TP Share Personal Information It Collects with Third Parties?

Yes.  TP provides the minimum information that is reasonably necessary to the following third parties who we have hired for hosting or development services:

  • Hostway, the company that provides webhosting services for our websites. Hostway undertakes certain activities to maintain the operational integrity of our website.  Please contact Hostway at 1-866-467-8929 if you have questions about its services.

We may also share information with:

  • Law enforcement, as required, or as otherwise required by law.
  • A new owner of the website if TP is acquired by or merged with another company or if ownership or control of TP is otherwise transferred to another company.

Does TP share Any Other Information it collects with Third Parties?

Yes.  TP’s parent company PGP is a partner in the Insemtives (“Insemtives” reflects 
combined terms in the concept ‘incentives for semantics’) Specifically Targeted Research Project funded by the European Commission’s Seventh Framework Programme.  PGP is involved in a part of the project looking at incentives for users to engage in annotations.  The partners examining the data are the University of Seigen and the University of Trento.  The project is coordinated by the University of Innsbruck Semantic Technology Institute. 
Non-personal information -- a player’s auto-generated space cadet name and 
the number of “Stars” earned by the space cadet in a game on the Tiny Planets Lab site -- will be shared with the research partners.  A statistical analysis of this data in the aggregate will be performed and summaries of the data will be used by the research partners for its role in the project.  The aggregate data does not identify individual users. The aggregated data will not be shared with third parties or used for commercial purposes. A parent or legal guardian may withhold consent for the sharing of their child’s annotation data with TP’s research partner without preventing their child from participating in this activity.

Can a Parent or Legal Guardian Withhold Consent to Disclose a Child’s Personal Information to Third Parties?

Yes.  A parent or legal guardian may withhold consent to TP’s disclosure of
personal information to third parties by following the directions on the manage your account page of the website. Even if you initially consented you can change your mind.  However, if disclosure of that information is reasonably necessary to enable your child to participate in specific activities -- or even play the game -- then your child may be precluded from participating in those activities or playing the game.

How Can a Parent or Legal Guardian Review their Child’s Personal Information?

A parent or legal guardian may review their child’s personal information by following the 
instructions on the manage your account page of the TP website.  
How Can a Parent or Legal Guardian Tell a TP Website to Stop Collecting a Child’s Personal Information? 
A parent or legal guardian may tell us to stop collecting personal information by 
following the instructions on the manage your account page of the TP website.  We will promptly stop collecting a child’s personal information.

How can a Parent or Legal Guardian have their Child’s Personal Information Deleted from a TP Website?

A parent or guardian may delete a child’s personal information by following the instructions on the manage your account page (http://tinyplanetsfun.com/mtpaccounts) of the website. The information will be deleted promptly.  Information may remain in backup storage for a period of time after a deletion request, even though we will not use the information.

How Can a Parent or Guardian Learn of Changes to TP’s Privacy Policy?

TP’s privacy policy may be updated periodically if our practices change or if changes in the law require us to do so.  We will notify customers about material changes in our privacy policy by e-mail or by posting a prominent notice on the home page of TP websites.  Continued use of the TP websites indicates your acceptance of material changes to TP’s privacy policy. 

Inactive Accounts.

The names of users, planets and landscapes are retained for six months to facilitate reactivating an inactive account.  If accounts remain inactive for longer than six months they will be deleted along with any saved stars, keys, planets, spaceships or cadets.

ACCEPTANCE OF TERMS AND CONDITIONS.

These Terms and Conditions govern your child’s use of the TP websites. The rules set forth below apply to all materials, online communications and other information that is available now or will become available on the TP sites.  By agreeing to these Terms and Conditions and the TP Privacy Policy (http://tinyplanetsfun.com/privacy), you expressly accept these Terms and Conditions and agree to abide by these rules, including any modifications to them. It is on the basis of your agreement to these Terms and Conditions that TP allows your use of the TP websites.

The terms “you” your”,” yours” or “user” mean a child visiting, using or participating on the TP websites and his or her parent or legal guardian. Unless specified, the term “child” refers to any individual under the age of 13.

TP is an online environment for children and their families.  Your child must understand the need to protect his or her personal privacy online, including on the TP websites.  Please explain this need to your child and instruct your child that any information or content posted online:

  • Must not identify your child or your child’s parent(s) or legal guardian(s).
  • Must not identify another child or another child’s parent(s) or legal guardian(s).
  • Must not be harmful to others.

TYPES OF ACCOUNTS.

TP offers two types of accounts: A free account and a premium account for premium services.  A free account permits children to participate for free in certain activities on the TP website or its hosted accounts.  A premium account must be purchased by a child’s parent or legal guardian.  It enables players to engage in the same activities as a free account as well as in additional activities, including purchasing virtual currency (“keys”) which can be used to unlock Tiny Planets TV episodes, interactive books, and casual games on the TP sites.  On My Tiny Planets, keys can also be used to unlock premium content, such as planet landscapes, enhanced cadet customization and have the opportunity to have a player’s auto generated username posted on the site’s “leader” board. TP reserves the right to modify or discontinue any of these activities or other activities on the website not listed here.  TP also reserves the right to add other activities to either type of account in the future and will notify parents as necessary.

PERSONAL NATURE OF LOGIN-INFORMATION AND PROMOTION CODE.

Your log-in information and promotion code may not be shared with anyone else and may only be used by you. By using the TP website you agree to maintain the confidentiality of your log-in information and promotion code.  You also agree not to use another user’s login-in information or promotion code.  You agree to notify us immediately upon becoming aware of the loss or unauthorized use of your log-in information or promotion code.  TP reserves the right to delete or a change a promotion code at any time for any reason.

OBLIGATION OF PARENT(S) OR LEGAL GUARDIAN(S).

TP requires that a parent or legal guardian supervise your child when he or she creates a user account – regardless of whether it is a free or premium account.

Premium Accounts. A premium account can only be created by a child’s parent(s) or guardian(s). By creating an account for your child you are agreeing that the information you provide is true, accurate, and complete.  If TP suspects or has reason to believe that a child’s account was created without the supervision of that child’s parent or legal guardian, or if the registration information is not accurate or otherwise violates these Terms and Conditions or the TP privacy policy (http://tinyplanetsfun.com/privacy), your account may be suspended or terminated without notice.

PROHIBITION AGAINST ROGUE PROGRAMMING.

Users shall not post, transmit or make available in any way through TP, or its companion websites,  any software or other materials which contain a computer virus, Trojan horse, time bomb, worm, malicious code or other programming or application, or other “rogue programming.” TP has no obligation to search for or detect rogue programming. If you download content or other information from any of the TP websites you do so at your own risk and sole discretion and should take adequate precautions to protect against the effects of rogue programming.

PROHIBITED CONTENT.

Users are prohibited from posting objectionable, inappropriate, unacceptable or unlawful content on any of the TP websites.   Some examples of prohibited content are listed below.  The list is not exhaustive and serves only as a useful guidepost.  If you are in doubt about whether your content is objectionable, inappropriate, unacceptable or unlawful you should refrain from posting it. Content is prohibited if it:

1. is offensive for the designated forum (in this case a child-only website);
2.    promotes racism, terrorism, hatred, bullying (whether verbal, physical or both) or   
physical harm of any kind;
3.    harasses others or advocates harassment of others;
4.    is sexual;
5.    is menacing or threatening;
6.    discloses information that identifies a specific child, his or her parent(s) or legal  
guardian(s) or enables a specific child to be contacted;
7.    solicits personal information from or about a child or otherwise encourages others to
post or to solicit personal information from or about a child;
8.    promotes information that is slanderous, defamatory, and libelous or otherwise
false;
9.    promotes or otherwise encourages any illegal, fraudulent, or unlawful activity;
10.  is connected with the transmission of unsolicited communications;
11.  is commercial in nature or relates to commercial activities;
12.  changes the appearance of the TP website or any part of it; or
13.  is created with the intention of, or has the effect of, interrupting or disrupting the
TP website, its services, or otherwise contains, makes available, or transmits rogue
programming.

TP reserves the right to reject, refuse to post or remove content in whole or in part of whatever nature from the TP website.

OBLIGATION TO ABIDE BY APPLICABLE LAW.

In addition to all of the rules above, you and your child shall abide by all applicable federal, state or local laws, and the laws of other countries and jurisdictions, including those pertaining to such areas as libel, slander, defamation, trade libel, product disparagement, harassment, invasion of privacy, tort, obscenity, indecency, and copyright or trademark infringement.  Content available on TP may include intellectual property that is protected under the copyright, trademark and other intellectual property laws of the United States and/or other countries. These laws generally prohibit unauthorized reproduction, distribution or exhibition of all text, photographic and graphic (art and electronic) images, music, sound samplings and other protected materials. The violation of these laws may give rise to civil and/or criminal penalties.

MODERATED CONTENT.

We are not responsible for moderating content that might be posted on any of the TP websites.  However, we reserve the right to monitor and review, through human moderators or filtering software, content posted on the sites and remove or refuse to post it at any time if, in our sole discretion, it violates these rules or either action is otherwise warranted.

NOTICE AND TAKE DOWN.

If we are informed or if we suspect that any material posted on any of the TP websites infringes, violates, or misappropriates the intellectual property or other proprietary rights of any third person or is otherwise unlawful, then we shall have the right to immediately remove such material from the website. We also reserve the right to remove any material submitted which we consider, in our absolute discretion, to be offensive, insulting, defamatory, obscene, indecent, objectionable or otherwise inappropriate or which is posted in breach of these Terms and Conditions.

You agree that you shall indemnify us against any loss, liability, claim, damage or expense incurred by us arising out of any breach by you of this Section.

RIGHTS IN CONTENT.

TP. All text, graphics, user interfaces, visual interfaces, photographs, sounds, artwork, computer code (including html code), programs, software, products, information and documentation as well as the design, structure, selection, coordination, expression, "look and feel," and arrangement of any content contained or available on the website, unless otherwise indicated, are owned, controlled, and licensed by TP and are protected by law, including, without limitation, intellectual property laws. The website also contains certain content which is used under license by TP and which is subject to intellectual property rights and legal protections, including copyright and trade mark rights, and related proprietary rights.  TP retains all rights in this content and in the website.  When you subscribe to or use the website we grant you a revocable, non-exclusive, limited, non-sublicensable right only to reproduce content for your own personal, non-commercial use and only in connection with the viewing of and participation in the TP’s activities.  You agree to exercise this right in accordance with the rules and restrictions and any other that may appear on the TP website, provided that all hard copies contain all copyright and other applicable notices contained in such materials and information.  These Terms and Conditions provide only a limited license and are not an assignment or sale.  We reserve all rights not expressly granted.

Third Parties. You agree to respect all third party content and the intellectual property rights in it that may be posted occasionally on the TP websites. You are prohibited from copying, changing, adapting, translating, publishing, making available to others or otherwise using third party content unless we specifically grant written permission for the specific use and manner that we permit. We do not create third party content and are not responsible for third-party content or any messages conveyed by it.

WEBSITE CURRENCY.

Account users can earn “Stars” when they participate in the game. Stars do not have any monetary value, cannot be purchased or transferred, and are in no way redeemable for actual currency.  Stars are allocated, managed and can be removed by us at our sole discretion.  Upon termination of your or your child’s account, for whatever reason, all Stars will be lost and cannot be retrieved or redeemed.

“Keys” are a form of currency to unlock premium services that parents can purchase for their children by following these directions: http://tinyplanetsfun.com/mtpaccounts.  Keys do not have any monetary value, cannot be purchased or transferred, and are in no way redeemable for actual currency.  Keys are sold, and managed by Social Gold / Jambool, our payment provider.  They can be removed by us at our sole discretion.  Upon termination of your or your child’s account, for whatever reason, all keys will be lost and cannot be retrieved or redeemed.

PERSONAL INFORMATION.
You understand, acknowledge and agree that your use of the TP websites may require the collection from you, storage and sharing of a limited amount of personal information.  This information will be used solely for the purpose for which it was requested.  By using the TP websites you accept TP’s information collection and use practices and policies.  Please review TP’s privacy policy (http://tinyplanetsfun.com/privacy) for a detailed explanation of those practices.

TERMINATION OR SUSPENSION OF ACCOUNT.

By a Parent or Legal Guardian. You may notify us at any time and for any reason that
you wish to terminate your TP account by following the directions on the manage your account page.  The account will be terminated immediately although you may be billed through the end of the then current premium service payment period.  You are not entitled nor will we provide a refund, in whole or in part, for any unused service, including remaining currency or customized characters, during this or any other payment period.

By TP. TP reserves the right to suspend or terminate your account at any time and without notice to you in the event you breach or otherwise fail to comply with any of these rules or if the website  is no longer operational or in the event of nonpayment.

DISCLAIMER.

TP is a light-hearted, fictional look at outer space and is directed to children under 14 and their families.  As such, TP and its hosted websites are  provided on an “as is” basis without warranties of any kind, either express or implied, including without limitation warranties of title, non-infringement or implied warranties of merchantability or fitness for a particular purpose.  Content posted on the websites do not necessarily reflect TP’s views or opinions and we do not endorse it or the views or opinions of those who post it. TP does not warrant that any information posted on any of its website is complete or accurate, that service is compatible with your computer or other communications transmissions systems or equipment, or that service will be uninterrupted or error free, or that any information is free or rogue programming.

LIMITATION OF LIABILITY

TO THE EXTENT PERMITTED BY LAW, UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL TP BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES THAT MAY RESULT FROM THE USE OR INABILITY TO USE TP, INCLUDING WITHOUT LIMITATION USE OF OR RELIANCE ON INFORMATION AVAILABLE ON TP, INTERRUPTIONS, ERRORS, DEFECTS, MISTAKES, OMISSIONS, DELETIONS OF FILES, DELAYS IN OPERATION OR TRANSMISSION, NONDELIVERY OF INFORMATION, DISCLOSURE OF COMMUNICATIONS, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, OR STATEMENTS OR CONDUCT OF ANY THIRD PARTY INVOLVED IN PROVIDING OR PARTICIPATING IN TP SERVICES OR PRODUCTS, OR ANY OTHER FAILURE OF PERFORMANCE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, TP AND ITS PARENT COMPANY’S LIABILITY TO YOU ARISING FROM THESE TERMS OR USE WILL NOT EXCEED $50.00 USD.  SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION AND EXCLUSIONS MAY NOT APPLY TO YOU. RELEASE AND INDEMNITY.

CHOICE OF LAW AND JURISDICTION.

These Terms and Conditions shall be governed in accordance with the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction in respect to any and all disputes arising from them.  TP operates from offices in England.  TP makes no representation that the TP websites are appropriate or available for use in any particular location.  Those who choose to use any of the TP websites do so at their own risk and initiative and are responsible for compliance with applicable laws to the extent such laws apply.
